Filing Requirements in Australia – National Phase Entry
- Provide us with copy of your PCT number to identify your application
- A copy of any article 19 or 34 amendments
- English translation (along with a Certificate of Verification)
- The PCT National Phase Entry Deadline is 31-months from the earliest priority date
- No Power of Attorney documents are required
- Copies of any patent assignments
Filing Requirements in Australia – Convention or Direct Filings (non-PCT)
- Provide us with copy of your priority or basic application including specification, claims, drawings and abstract on a separate page
- A copy of any preliminary amendments
- The filing deadline is 12-months from the earliest priority date
- No Power of Attorney documents are required
- Copies of any patent assignments
- Certified copy of the basic priority or basic application(s) for Convention applications. While these may be lodged after filing of the application and prior to acceptance, it is preferred to file them as part of the initial filing.
- Translations of basic application(s) are not normally required. However, the Australian Patent Office may later require the applicant to lodge a verified translation of any basic application(s).
